Party Wall Awards & Party Wall Services

​​​​​As an RICS-regulated surveyor, I provide Party Wall services to building owners and adjoining owners across South London, including the preparation of legally binding Party Wall Awards under the Party Wall etc. Act 1996.

The party wall process can feel complex, but a well-prepared Award brings clarity and confidence.

 

I guide clients through the entire procedure — from valid Party Wall Notices to Schedules of Condition, and finally to the Party Wall Award when required.

What Is the Party Wall etc. Act 1996?

The Party Wall etc. Act 1996 is a legal framework designed to prevent and resolve disputes between neighbours when building works are carried out near shared boundaries.

When the Party Wall Act Applies

The Act covers three main types of work:

1. Work to an Existing Party Wall or Structure

Such as shared walls in terraced or semi-detached homes, or floors/ceilings between flats.

2. Building Up to or on the Boundary Line

For example, constructing a new extension or boundary wall.

3. Excavations Near a Neighbour’s Property

Typically for foundations, basements, or structural work within 3–6 metres of a neighbouring building.

What Is a Party Wall Award?

A Party Wall Award is a legally binding document prepared by appointed surveyor(s) when an adjoining owner dissents to a Party Wall Notice.

The Award sets out how notifiable works should be carried out, including timing, method, access, protection measures, and cost allocation, and protects both owners’ interests under the Party Wall etc. Act 1996.

Awards may include :

  • Details of the building owner and adjoining owner
     

  • The scope and description of the notifiable works
     

  • Schedules of Condition and photographs
     

  • Technical drawings, where applicable
     

  • Timing, access, and working arrangements
     

  • Allocation of costs, including surveyors’ fees
     

If adjoining owners consent to the Party Wall Notice, an Award is not required, but documented agreements and Schedules of Condition can still offer valuable protection.

Party Wall Services I Provide

1. Serving Party Wall Notices

Prepare and serve the correct notices in line with the legislation. Our experience ensures that your documents are legally sound, reducing the risk of dispute from the outset.

2. Schedule of Condition Reports

Before any work begins, we take a detailed, photographic, and written record of the adjoining owner’s property. This protects you both, and provides an objective benchmark in case of damage or disagreement later.

3. Party Wall Awards (Agreements)

We draft the Award: a legally binding document that sets out how the work should proceed to protect both parties’ interests. It ensures clarity, fairness, and compliance.

4. Representation For Adjoining owners

If you’ve received a notice, we’ll review it, make sure you fully understand the proposed works, and negotiate on your behalf — ensuring your property is protected, and your concerns addressed.

Most Party Wall Notices must be served at least one to two months before work begins, depending on the type of work and notice required under the Party Wall etc. Act 1996. The notice periods can be reduced by agreement.
